Terms of Service
These Terms and Conditions govern the sale of products offered on the elviozanon.com website by AWARDS SHOES S.R.L.. Please read them before placing an order: by submitting an order, you declare that you have read and accepted them.
1. SELLER
AWARDS SHOES S.R.L., with registered office at Via dell'Industria 14, 35020 Brugine (PD), Italy, tax code and VAT number 05539300284, registered with the Padua Business Register under no. REA 474561, certified email (PEC) awardsshoes@lamiapec.it, email support@elviozanon.com.
2. SCOPE OF APPLICATION
These Terms apply to all orders placed on the website. The Shipping Policy and the Returns and Refunds Policy form an integral part of these Terms. The processing of personal data is described in the Privacy Policy.
Products are sold exclusively to consumers, i.e., natural persons acting for purposes unrelated to any entrepreneurial, commercial, craft, or professional activity carried out.
To make a purchase, you must have the legal capacity to act and be at least eighteen years old.
3. PRODUCTS AND AVAILABILITY
The essential characteristics of the products are described on their respective product pages. Images are for illustrative purposes: colors and details may differ due to the settings of the device used.
Availability indicated on the website does not constitute a binding commitment. If a product becomes unavailable after an order has been submitted, we will inform you without delay and provide a full refund of any amount already charged within fourteen days.
4. PRICES
Prices are expressed in euros and are inclusive of VAT. Shipping costs, if applicable, are indicated separately before the order is concluded and summarized in the cart.
We reserve the right to change prices at any time. The applicable price is the one indicated on the website at the time the order is submitted.
In the event of an obvious material error in the price indication, we reserve the right to cancel the order by notifying you and proceeding with a full refund.
5. CONCLUSION OF THE CONTRACT
Submitting an order constitutes a contractual offer. The contract is concluded upon the sending of the order confirmation email.
After submitting the order, you will receive a summary email containing your order details and a reference to these terms. We invite you to check its content and report any errors to support@elviozanon.com.
We reserve the right not to process orders that show anomalies, contain incomplete or untruthful information, or originate from parties with whom there are ongoing disputes or outstanding payments.
6. PAYMENTS
The following payment methods are accepted: Shopify Payments, via credit and debit cards, PayPal, Klarna, Apple Pay, and Google Pay.
Payments are managed directly by payment service providers, who operate as independent data controllers for the relevant data. We do not have access to the complete details of the payment instruments used and do not store them.
If you choose a deferred or installment payment method, the relationship regarding the deferral is directly between you and the service provider, which may condition acceptance on an automated assessment of your creditworthiness and may refuse the requested payment method. The contractual terms and privacy policy of such provider shall apply.
The merchandise remains our property until full payment of the price.
7. TAX DOCUMENTATION
Sales made on the website are aimed at consumers and do not involve the issuance of an invoice: proceeds are recorded according to applicable tax regulations. If you require an invoice, you must request it at the time of the order, providing the necessary details for issuance.
The request for an invoice must be made at the time of the order. It is not possible to issue an invoice at a later date.
8. DELIVERY
Times, costs, areas served, and delivery methods are indicated in the Shipping Policy, which forms an integral part of these conditions.
The risk of loss or damage to the products remains with us until the moment the consumer physically takes possession of the goods.
9. RIGHT OF WITHDRAWAL
If you are purchasing as a consumer, you have the right to withdraw within 14 days, under the conditions and in the manner described in the Returns and Refunds Policy, which also contains the standard withdrawal form.
Pursuant to Article 54-bis of the Consumer Code, an online withdrawal function is available on the website, allowing you to exercise your right directly through the interface without sending separate communications. The function can be found in the website footer and is accessible for the entire duration of the withdrawal period. Its operation is described in the Returns and Refunds Policy.
10. LEGAL GUARANTEE OF CONFORMITY
Products are covered by the legal guarantee of conformity of two years from delivery as provided by the Consumer Code for the benefit of consumers, with the right of action subject to a limitation period of twenty-six months. Methods and remedies are described in the Returns and Refunds Policy.
11. LIABILITY
We are liable in accordance with the law. No provision of these terms limits or excludes liability for willful misconduct or gross negligence, for personal injury, or for liabilities that the law does not allow to be limited with respect to consumers.
We are not liable for delays or non-fulfillment due to force majeure or events beyond our reasonable control, including strikes, disasters, government measures, interruptions in communication networks, or carrier services.
12. COMPLAINTS AND DISPUTE RESOLUTION
You may submit complaints to support@elviozanon.com or to awardsshoes@lamiapec.it. We provide a response within 2 working days.
If the complaint is not resolved, the consumer may turn to alternative dispute resolution bodies registered in the lists kept by the competent authorities, pursuant to Articles 141 and following of the Consumer Code. Recourse to such bodies is optional and does not prejudice the possibility of taking legal action.
13. APPLICABLE LAW AND COMPETENT JURISDICTION
These terms are governed by Italian law. Mandatory provisions more favorable to the consumer provided by the law of the state of the consumer's habitual residence remain unaffected.
For disputes with consumers, the court of the place of residence or domicile of the consumer has exclusive jurisdiction. For disputes with parties who do not qualify as consumers, the Court of Padua has exclusive jurisdiction.
14. AMENDMENTS
We may modify these terms at any time. The terms applicable to each order are those published at the time the order is submitted.
15. FINAL PROVISIONS
The invalidity or ineffectiveness of a single clause does not affect the validity of the remaining ones. Tolerance of any breach does not constitute a waiver of rights arising from these terms.
